Tactical Laser Defense Systems, Inc. (“TLDS”)

1) General Notice
By purchasing, possessing, training with, or using any TLDS product, you acknowledge and agree to the legal responsibilities and risk allocations stated here. TLDS products are offered for lawful defensive, industrial, and training use only. TLDS assumes no responsibility for unlawful use.

2) Lawful Purchase, Possession, and Use
You are solely responsible for determining and complying with all applicable federal, state, and local laws governing acquisition, possession, transport, training, and use of TLDS products in every jurisdiction where you ship, store, or operate them. TLDS makes no representation that any product is lawful in any specific jurisdiction. Verify legality before ordering or using.

3) Aviation & Airspace Compliance (FAA / Federal Law)
Federal law treats unmanned aircraft systems (UAS) as “aircraft.” Damaging, disabling, or attempting to interfere with an aircraft—manned or unmanned—may constitute a federal crime (e.g., 18 U.S.C. § 32).
Aiming lasers at aircraft is a distinct offense (18 U.S.C. § 39A).
All UAS operations and any ground activities that could affect air navigation must comply with FAA rules, including 14 C.F.R. Part 107 (Small UAS) and Part 89 (Remote ID).
TLDS products are not certified as airspace control, interdiction, or spectrum-management devices. Do not use TLDS products to target, track, suppress, blind, or otherwise interfere with aircraft or within restricted airspace.

4) Laser Classification & Federal Safety Standards
TLDS devices are Class IIIb laser products. Direct or specular-reflected exposure can cause permanent ocular injury. Operate only as trained and as labeled.
Do not remove warnings, labels, or safety interlocks.
Do not aim at persons, animals, vehicles, or reflective surfaces.
Comply with 21 C.F.R. §§ 1040.10–1040.11 (FDA/CDRH laser product performance standards).
Follow applicable consensus standards (e.g., ANSI Z136 series) and employer safety programs.

5) Workplace, Range, and Organizational Controls
Entities deploying TLDS equipment must implement a laser safety program commensurate with hazard class, including: designation of a Laser Safety Officer; controlled areas and access; hazard signage; personal protective equipment matched to wavelength and optical density; standard operating procedures; incident reporting; and recordkeeping. OSHA obligations and ANSI Z136 controls apply where relevant.

6) Export Controls & Technical Data
TLDS products and related technical data may be subject to U.S. export controls, including the Export Administration Regulations (EAR), 15 C.F.R. Parts 730–774, and, where applicable, the International Traffic in Arms Regulations (ITAR), 22 C.F.R. Parts 120–130.
Do not export, re-export, transfer, or disclose controlled hardware, software, or technical data without proper authorization.
Diversion contrary to U.S. law is prohibited. Violations can carry severe civil and criminal penalties.
TLDS may decline, cancel, or restrict orders to ensure export-control compliance and end-use/end-user screening.

7) Training & Authorized Use Context
Training must follow TLDS Training & Safety Guidelines in controlled environments with appropriate engineering controls, PPE, and supervision. TLDS training does not confer any law-enforcement or airspace-interdiction authority and does not authorize use of force. End users remain responsible for all legal compliance.

8) Government / Law-Enforcement Carve-outs
Certain counter-UAS and interdiction activities may be authorized for designated federal agencies under specific statutes or directives (e.g., DHS/DOJ authorities). Unless you are expressly operating under such authority, assume no interdiction exemptions apply. TLDS makes no representation that any purchaser is covered by special statutory programs.

9) Misuse & Prohibited Conduct (Illustrative, Not Exhaustive)
Prohibited uses include, without limitation:
Aiming or employing any TLDS device against aircraft (manned or unmanned) or within navigable airspace;
Using a TLDS device as an offensive weapon or to menace, harass, or impair others;
Defeating or bypassing safety features;
Operating outside labeled ratings, training parameters, or applicable law.

10) Product Evolution; Technical Changes
TLDS may implement design/material/specification changes prior to release that do not materially degrade intended performance. Images/renders may differ from shipped hardware due to iterative safety or reliability improvements.

11) No Duty to Warn Beyond Applicable Law
Safety information furnished by TLDS (manuals, labels, updates) is provided to assist compliant operation. Laws and regulations may change without notice. Users must monitor and comply with current legal requirements and manufacturer bulletins.

12) Warranty Disclaimer; Assumption of Risk; Limitation of Liability
Except as expressly provided in a written TLDS limited warranty accompanying a product, TLDS PRODUCTS AND THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT ANY EXPRESS OR IMPLIED WARRANTY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TLDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS/REVENUE/USE/DATA), NOR FOR ANY INJURY OR DAMAGE ARISING FROM MISUSE, ILLEGAL USE, OR OPERATION OUTSIDE STATED PARAMETERS. PURCHASER/USER ASSUMES ALL RISKS ASSOCIATED WITH OPERATION AND COMPLIANCE.

13) Indemnification
You agree to indemnify, defend, and hold harmless TLDS, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your breach of these Legal Notices or applicable law; (b) misuse or unsafe operation; or (c) export-control violations.

14) Governing Law; Venue
These Legal Notices are governed by the laws of the State of Delaware, U.S.A., without regard to conflict-of-law rules. Exclusive venue for any action not otherwise preempted by federal law shall lie in the state or federal courts located in Lincoln County, Oregon.

15) Revisions
TLDS may revise these Legal Notices at any time. Updated versions take effect upon posting.
